Claim Chart是什么东西
Claim Chart的中文翻译一般是指权利要求对照表或者侵权对照表,就是将授权专利的权利要求特征与涉案产品的技术特征进行比对。
Claim Chart的结构形式
Claim Chart有多种形式,普遍采用的是左右对照式的Excel表格形式,即一侧为授权专利的权利要求特征,另一侧为涉案产品的技术特征。

如果授权专利的权利要求1中的全部特征在涉案产品的技术特征中可以全部找到,那么涉案产品即构成侵权。即使涉案产品包含技术特征E’,其未在授权专利的权利要求中予以保护,那么也构成侵权。

Claim Chart的意义
Claim Chart在专利侵权诉讼与专利许可中意义重大,特别是在欧美地区,侵权诉讼需要提供Claim Chart。而在专利许可当中,Claim Chart由专利持有公司编写,其可以直观的看出许可专利(即授权专利)与被许可公司产品(即涉案产品)之间的关系。但通常在专利许可当中Claim Chart属于保密信息,很少有许可方愿意在没有签署NDA(non-disclosure agreement,保密协议)的情况愿意提供Claim Chart,所以在网络上一般很少能看到许可中用到的Claim Chart。对于许可方来说,Claim Chart写得好至关重要,Claim Chart也是双方谈判的基础。
